Section 230 and the platform problem creators keep running into
Section 230 is supposed to protect platforms. The way it functions in 2026 also protects platforms from the creators they host.
Section 230 of the Communications Decency Act is the statute that allowed the modern internet to exist. It tells courts that interactive computer services are not the publisher or speaker of content their users post. The doctrine was written to protect platforms from being sued for what users said. It has done that, durably and broadly, for almost three decades. What it has also done, less discussed in the legal commentary, is shape the relationship between the platform and the creator in ways that creators in 2026 should understand more clearly than they often do.
The protection is not just from lawsuits about user content. The protection has expanded, in the federal courts that hear these cases most often, to a broad immunity from claims arising out of “publisher” decisions. That includes decisions to remove a creator’s content, to demote it, to demonetize it, to suspend an account, or to shape a feed in ways that disadvantage some creators relative to others. The platform’s terms of service are largely a one-way contract because Section 230 sits underneath them as a backstop against the creator’s claims.
For creators trying to understand why their leverage against a platform is so limited, this is the structural answer. The platform’s contract with you is a small part of the picture. The federal statute that says the platform cannot be liable for editorial decisions about your content is the much larger part.
That has three practical implications worth holding onto in 2026.
The first is that the meaningful battles over platform behavior are mostly not contract battles, because the contracts already say what they need to say. They are public-affairs battles, antitrust battles, and battles in jurisdictions outside the United States that do not have a Section 230 equivalent. None of those is a fast lane. All of them are slower than a creator typically wants.
The second is that diversification of platforms is no longer a marketing recommendation. It is a legal-risk recommendation. A creator whose income depends on a single platform’s continued goodwill is one moderation decision away from a problem with no clear remedy. The income should sit on at least two surfaces, and ideally on a surface the creator owns directly, like an email list or a web property.
The third is that the contracts you can negotiate (your brand deals, your management agreements, your licensing deals) should not assume the platforms will be reachable through legal process. They will not be. So the contracts need to allocate platform risk explicitly: who bears the cost if a campaign cannot run because of a moderation decision, who owns the rights if content is taken down, what the make-good is when a platform changes the rules.
Creators do not need to like Section 230. They do need to understand that it is the architecture they are building on, and to build accordingly.
